I'm more bothered that the Church is resorting to profane law to manage the holiest of holies. Additionally if the Church wins, it will lead to strange legal ideas...Could a bishop sue his priest for distributing communion to a pro-choice person or married and divorced, could this priest be sued for misuse of Church property? On top of all this all this does is create some legal fiction to make us feel comfortable that we've made a differnce. If I were to illicitly obtain a consecrated host for some ritual all I would need to do to cover myself is purchase a $14 box of communion hosts now I have sufficient doubt to protect myself legally.

Depending on jurisdictional specifics, I wonder if a case could be made for theft by deception. That said, it would be very difficult to have a solid case without self-incrimination by the perpetrators. While it's generally assumed that the participants in a Black Mass are abusing a host consecrated by the Catholic Church, how do you prove it? Altar breads run about $17 per thousand on Amazon. If they want some sort of consecration or the thrill of misappropriation, I doubt that Satanists care about Apostolicae Curae - they could have taken it from the Episcopalians.
