Not quite what I was going for in my analogy. Despite what Walmart claims, they do have sales from time to time. They just don't advertise that they are going on like other places might.

My basic point was to try to state that having low prices or even offering products at a fixed price point doesn't mean that prices are fixed. You have to prove more than just that, like showing that the business is both ignoring what market conditions demand for the product, as well as having intentionally coordinated with the other party to rig the market. And even then, there are some industries where it isn't seen as a problem to do that.
Read here if you don't really get it.

In FSF's case, just because they advocate for free software doesn't mean they are colluding to keep prices down in the rest of the software market. Especially when anyone can come into the market themselves and sell support services on top of that software independent of the creator, or use it to help implement a more complex product for sale (e.g. FixMe Stick is a bootable Linux antivirus solution).
