A multitude of reasons.

  1. I don't agree with Capcom's reasoning behind it. They claimed that Ace Attorney has "struggled with sales in the past", but nearly every entry shattered sales expecations and/or had to have multiple print runs to meet the insane demand. Keep in mind that this didn't happen just once, but for nearly every main entry in the series. There was even a reprint earlier this year. On top of all that, these games are on no less than 3 systems (Wii, DS, and an "HD" port for the iOS) and it costs money to reprint and port them, so these games certainly arent the failures Capcom seems to be implying they are. If they were, why would they have bothered with all of that?

  2. Much more niche games from much smaller companies have physical releases and do just fine. My favorite example is 2012's Hakuoki on PSP. It had a Limited Edition and a Standard Edition physical print run. Why is that important? Well, because it was a PSP exclusive visual novel marketed towards women. That's about as niche as you can possibly get. And it still sold well enough for Aksys to continue work on the series. It's 3DS port is being released this year and its spin-off title was released earlier in the year. Both of which have physical releases mind you, with the 3DS game also having an LE.

  3. Nintendo's digital distribution is a gamble because of their policies. Nintendo will not allow you to redownload your games if your system is lost, stolen or fails. I learned this the hard way when my Wii was stolen. I called Nintendo and was told that I couldn't get my games back without paying for thema second time because they are treated as if they are physical items. Nobody else does this. And before someone hits me with the "but if your physical games get stolen they won't replace those" argument, let me put it into perspective: They're DIGITAL games. If my Vita or PS3 die or get stolen, I can just redownload all my digital games to the new systems. The same goes for my phone, 360, PC and even PSP. As such, I've started to avoid buying full price retail games from the eShop. Nintendo got me to download Animal Crossing with the $30 eShop promo from SMT 4 and FE:A, but that is the last retail title I will download from the eShop.

  4. EDIT: A smaller reason that may seem silly to others but is incredibly important to me: I am a hardcore game collector and I own all the other games in the series with box and all. To have the 5th (6th if you count AAI) one on just an SD card while every other entry in the series sits on my shelf in a box bugs me as a collector of physical copies.

    It just baffles me that Capcom is treating it like it's some huge risk and liability when the series has historically done much better than they predicted and even more niche games do fine as well. At the very least, they could do an incredibly small print for those that want it (pre-orders and then a little bit of excess for store shelves) and then let the eShop handle the rest for those that don't care. Everyone wins there. Capcom doesn't print too many copies that may not sell, those that want the game on a cart get it and those that don't care can get it on the eShop.
