So test it yourself -- they sell mold testing kits at hardware stores and other places around town. Get one, follow the instructions, send it off to the lab, and when the test results come back positive for being toxigenic, you will have much stronger footing with respect to your legal avenues of recourse.

Edit: this one can tell you whether it's toxic black mold or not.

This is what I'm using, but I'm also considering having someone come onsite to test the air. There are some very highly rated places nearby, and I feel it will be much more thorough.
